Case Study 1

Dave was bankrupt and he and his partner Jolene jointly owned their property. The bankruptcy trustee threatened them with eviction. We negotiated for them with the trustee and were able to stop the eviction and negotiate a settlement figure which David and Jolene raised partly by a remortgage and partly with help from the family.

Case Study 2

Just before Liz was made bankrupt she sold her life policy and paid the £5,000 she received for it to her mother for a debt she owed her. Liz's mother then spent most of the money on a holiday. The trustee wrote to Liz's mother and said that he wanted the money back because it was a preference. We persuaded the trustee to accept less than £1,000 in settlement.

Case Study 3

Sam and Safi had been advised before Sam went bankrupt that Sam should sell his equity in the property to Safi to protect the property in the bankruptcy. The equity was £4,000 and on advice the equity was transferred to Safi for £1. The trustee tried to bully Sam and Safi into believing that they had received wrong advice, and that they would still have to lose their property or pay something to him. We produced evidence to the trustee which persuaded him that he could no longer do anything about the property, which meant that the property was saved.
