Myvesta UK FAQs

Redundancy Payment

Question: I am recently discharged, and am now due a redundancy payment post discharge. My trustee knows about the payment and has asked me to sign an undertaking that the full amount should be paid to him even though I will receive it after my discharge.

Answer: Technically after you are discharged anything you would receive is yours, however if the OR knows of this payment they may try to gain an interest in it prior to you receiving it to use for the bankruptcy.  I am unsure what the outcome would be if you do not sign the undertaking as you have been discharged and what the OR's authority at this point is unclear as you have been discharged.

You may want to query this either with an Insolvency Practitioner or also at www.insolvency.gov.uk
