Question: Back in 2006, i suffered severe financial problems which culminated in having our house repossesed and being kicked into the hands of the local council for housing. At the time, we had considerable unsecured debts plus the mortgage. we were trying to sell the property, pay off the mortgage and debts and move into rented to give ourselves a new start, however, we couldnt find a buyer and the house was reposessed. once the property was eventually sold for less than £100k, we still have some outstanding mortage and the unsecured debts of around £80k. I havent worked since this time due to poor health and negoitated with al the creditors to pay a £1.00 per month against these debts. some took me to court and got ccj's against me but as i had nothing and only offered a £1.00 the judge was in my favour in all cases. its been now three years and im never going to be able to pay off these debts, and im considering bankruptcy to clear them - however, i cannot afford the fee to do this and one of my creditors is the inland revenue who tells me that if i go bankrupt he will still be able to collect his tax from me? can this be right as all my debts are now unsecured, even those with ccj, and i have no goods worth anything to him. additionally, if i go bankrupt, and i have no income or assets, do i have to be mindfull of furniture or any day to day goods like tvs and that and how will the official receiever handle my case with money to be split to the creditors when i dont have any?
Answer: In bankruptcy all your debts are placed and this includes taxes to the Inland Revenue and all CCJ's.
You maybe able to get assistance with the fees for bankruptcy through a local utility provider as some have grants they can offer if you meet their eligibility. You will need to contact them to inquire about this.
In bankrutpcy you are allowed all your personal possessions, TV, computer, furniture, etc.
