Public Examination hearing

Postby upanddown on 06 May 2009, 07:37

The OR is taking steps to fix a Public Examination hearing at court. From what I can gather from online searches, these are used to obtain information from uncooperative people, but I have always answered letters and spoken to OR when requested.
Can anyone tell me anything about the hearings; is it like an interview? Abit confused!! Thanks

A public examination would normally mean that the OR has not been able to get information or a sworn statement that he has requested from you, or that he feels that answers not given under oath are unsatisfactory or need further confirmation. His application for the hearing will have full detail of his concerns; you could ask for this once it's been made.

At Court you would swear an oath, and the Official Receiver (or an Assistant Official Receiver) will ask questions in front of the judge. Both the questions and answers will be recorded in full.

Have they been asking you "Where is the money?" type questions recently?

They are asking for full contact details of a man who I bought some horses from 4 years ago (for my business). trouble is I only know his first name and as there is no paper work as such, I can't tell them; quite simply I just don't know!!
There seems little point asking me in court; I can't just make it up (beginning to wish I had!)

Thanks for taking the time to reply

Can you show evidence of the horses having come into your possession and that horses of their nature would normally have cost whatever you paid? Was this an exceptional transaction?

I can certainly show that similar horses do cost what I paid, and that these horses came in to my possession (I had them vaccinated hence I have documentation). The OR wants the contact details of the man I bought them from, although says they are not seeking to recover any money from him. I will ask for copy of the application as suggested, see if I can throw any more light on it all!

Court date looming 24th June......
