8 years on and still condemed

Postby storeton on 16 Oct 2008, 22:30

20/04/2000 was my bankrupcy order and discharged 3 years later
is that the end of the story now in 10/2008?
have applied for remortgage
everything o.k. except a default put on my credit record by RBS in 2003 relating to a credit card debt which was included in my bankrupcy list of unsecured creditors
any advise on this would be most appreciated
thanks

Hi there
Was the default added to your CR file after you were discharged from BR or while you were still BR. If you were still BR when it was added, the default should have been added to your file no later than the date of your BR.
I would write all the CRA's and RBS and ask that the default be moved to the date of your BR or removed altogether, this will bring the default into dispute and the CRA should flag it as such while they decide on what to do.
It may be a long drawn out process as the CRA needs the permission of the bank to make any changes to your account, the bank will say that the information supplied is correct blah blah blah.
Are tha bank still reporting to the dafault do you know? as if the account is closed then I should think that they me breaking the Data Protection act by reporting on a closed account with out your permission as the account should now be closed.

Let us know how you get on will you,

Regards

Geoff.
