Hi my huband and I are going to go bankrupt in the next couple of weeks, just in process of setting up basic account with nationwide and change DDs etc and have wages paid in before we go, so as we can live. We just hope this is correct procedure? Where do we get the forms from to file our bankruptcy? Where do we send them and how long from that date do we actually go bankrupt?? Would really appreciate a reply as we need to move on this quickly before we both crack up from the strain.

Hi there.
You can go online and fill in all of the details here https://www.insolvencydirect.gov.uk/isolv , or you can phone your local court and ask them to send the bundle of papers to you to fill in. Also make sure that your local court handles Bankruptcy hearings. You should be able to book a date with them over the phone.
Give yourself at least two weeks to fill all the forms out and make a point of saying that your new bank account is a basic account only and that you have just opened it for your salary etc to be paid into.
yOU WILL TAKE YOUR FORMS ALONG TO THE COURT WITH YOU ON THE DATE OF YOUR HEARING.(Whoops)
They will be checked out by the bankruptcy clerk who will be with you for a while, if you are both going BR then ask the clerk if you can both go in to see the JUdge together.
Once the Judge has signed the paperwork, then thats it, you are officially BR.
iF YOU ARE STILL PAYING ANY CREDITORS, IT IS A GOOD IDEA TO STOP PAYING THEM AND USE THE MONEY TO PAY FOR THE COURT FEES AS THIS is a fair amount and at the end of the day the amount will not make any differnce to the amount that you owe.
As I say, give yourself time to fill out the forms as they can be quite daunting.
