Life after the IVA

Tips and stories from those who have entered an IVA and how they coped with it and what life is like today.

Life after the IVA

Postby Steve_1956 on 06 May 2008, 10:50

I started an IVA back in March 06 and managed to come out of it in September 07. I feel that life hasn't moved on for me in so far that that nothing has changed.

I still have a poor credit rateing despite my IVA supervisor telling me otherwise.

I had to get a subprime mortgage inorder to pay off my IVA again despite My IVA Supervisor, telling me i could go to my exsisting company to obtain funds.

I'm also now finding out that some companies/creditor's are refusing to remove my credit data from Experian and Equarfax, as they only received a partial payment, albeit they agreed to the settlement.

And I'm now being told by my IVA company that some companies are now doing this. and are still updating my credit file each month either with late payments ot defaults. or partial payment.

So whilst the telephone and the letters have stopped there are still things going on in the background that no one can stop or indeed wants to stop,or help with.

Also I feel that the amount of money being charged by my IVA Companie, Mine was in the region of £95:00 per hour I would like to think they would have had this information to hand. or indeed have given me the advice as to the best way forward,

As I now feel that even having settled my IVA it will still be hard for me to get back on track as i I'm still having to live with restrictions, like not even having a proper bank accout

So despite being able to clear the IVA I'm not really any further forward. and the IVA Company do not return my phone calls even after speaking with a member of the team from My Vesta, who told me they would.!!!

If anyone has any suggestions on how i can move this forward or indeed have experienced the same issue's I would love to know how you got over it.

Many thanks

Steve

Hello

I'm sorry to see that you've had problems.

Ultimately I hope the IVA has been better for you than it might seem when you dwell on the negatives. It sounds like your financial problems have been managed in a calm and ordered way, and it is now the case that you don't need to pay the people wanting money from you!

As you have no obligation to pay these people money they shouldn't be updating your credit record with information to suggest that you should be.

You could approach seeking correction of your records from a data protection act point of view; these people have and are processing personal information regarding you and should not be doing so in a way that it incorrect.

it won't be experian you need to speak to further than to obtain a copy of the report (which it seems you have), it'll have to be the lenders that provide the data to them.

What if the lenders refuse to update their files.

do defaults and IVA details stay on your credit file for 6 years regardless of if you do a Full and Final settlement.

Is there anyway to clear up my credit file sooner than 6 years?

Can they default me thoughout the life of the iva, thus taking me 12 years to clear my name?

How do I get my personal details taken off the insolvency register, I was not told about this when I signed up for IVA yet I now get loads of junk mail in the post, mainly from the IVA council despite telling them not to pester me.
