i am in debt of around 20k and i am seriously considering bankruptcy. just recently i got married and me and my partner asked 2 friends if they would take out loans for us so we could pay for the wedding ect.. which they did and now on top of 20k i owe we also owe 12k to friends. I have been paying their monthly direct debits through my bank account which didnt leave me with any money to pay for my debts in my name.

to make things worse my and my partner were asked to move out of my parents house so we are now living in rented accomodation so we now also have rent and utilities to pay, all this has got to much and all we do is argue and fight all day which is breaking us apart so i want to call myself bankrupt and have a clean start.

the problem i have is that the OR will ask to see my bank statements and they will see i have been paying the loans of which my friends took out for and not my own debts, will this be a problem? what could happen? i am realy worried as i am in a realy bad situation.

The only way out i can think of is trasnfer all the direct debits for friends loand to my partners bank account and i start paying the rent and house bills from my account which still wont leave me enough money to pay for my own debts. so i can call myself bankrupt. but the problem with this is when the OR asks to see my bank statements they will see direct debits going from bank account to pay my friends loans off and not my own debts or will this not be a problem because i am going to put all DDs into my partners account and the rent and bills from mine.

please please can someone here give me some advice on my situation. all help will be very much appreciated as it feels like im going crazy!

Hello

What sort of timescales are involved? For how long have you been paying your friends but not other people? Also, what is the monthly amount?

Hi. Thankyou for your reply, it is very mch appreciated.

I have been paying the 2loans my friends took out for us since february 08 and i moved into rented accomodation in july. the monthly amounts put together for both loans come up to £330. hope this helps with your reply.

Hello

At the moment it's hopefully not really too big a problem, as the amounts involved so far are small.

However if this was to continue it would definitely be seen as wrong, and the OR would definitely ask your friends for the money back.

I know this is unfortunate as it's what anyone would want to do, but bankruptcy legislation is based on the idea that in return for protection from creditors, everyone should be treated the same.

The Official Receiver would also see it as wrong for you to be paying the full household expenses when you are sharing with someone else.
